General Terms and Conditions of YouBoat GmbH (Boat-School.ch)

These General Terms and Conditions (GTC) apply to all offers provided by Boat-School.ch.

1. General Provisions

By booking a service, you enter into a contract with YouBoat GmbH and agree to the Terms and Conditions of YouBoat GmbH. You will receive a booking confirmation alongside the corresponding invoice. The payment due date specified therein is binding.

Failure to pay the invoice does not constitute a withdrawal from the contract.

2. Due Date for Course Fees

Course fees become due according to the payment terms specified in the booking confirmation/invoice. If payment is not received within this timeframe, the final reservation for the agreed-upon dates cannot be guaranteed. If the invoice remains unpaid despite repeated payment reminders, we reserve the right to charge a late fee of CHF 30.00.

3. Course Execution

Lessons will take place regardless of the weather.

Bad Weather / Storm Warning / Force Majeure: The instructor or the management of YouBoat GmbH shall decide on-site whether to conduct or continue the course based on the situation.

In the event of unacceptable or hazardous conditions, the boat school reserves the right to cancel and reschedule the course without incurring any liability for damages.

4. Cancellation of Courses

Cancellation or withdrawal from a booked course/subscription must be communicated in writing. Depending on the timing of the cancellation, the following terms apply:

  • Up to 14 days before the start of the course: Cancellation is free of charge; any course fees already paid will be fully refunded.

  • 13 to 7 days before the start of the course: Cancellation is possible, but an administrative fee of CHF 200.00 will be charged or deducted from the refund amount.

  • Less than 7 days before the start of the course or in the case of non-attendance: No refund will be given. The full course fee (100%) remains due.

5. Rescheduling or Missing Booked Lessons/Courses/Events

Confirmed lessons can be rescheduled free of charge up to 48 hours prior to the start of the course/lesson. For rescheduling made less than 48 hours before the scheduled time, the lesson is forfeited and will be charged in full.

6. Responsibility During Practical Training

The respective YouBoat GmbH instructor holds responsibility and authority to issue instructions. They are responsible for the vessel and the crew. Consequently, every course participant is obligated to comply with the instructions given by the instructor.

7. Health Condition of the Course Participant

To participate in practical courses on the boat school vessel to obtain the Swiss skipper's license (Categories A and D) or in other courses, the participant declares that they are in good health and able to swim for 15 minutes. In the event of health problems, allergies, or a lack of swimming ability, YouBoat GmbH must be informed in writing prior to commencing the lesson.

8. Exam Registration and Exam Fees

The registration and coordination for the practical exam, as well as the associated details, are handled by the YouBoat GmbH office. The costs for the practical exam, as well as the warm-up/prep time and boat rental, are charged based on actual time at the standard hourly lesson rate. YouBoat GmbH provides no guarantee of exam success.

9. Insurance / Liability

For the duration of the practical training, the course participant concludes a mandatory, one-time nautical insurance policy through YouBoat GmbH. This covers damage to the training vessel, third-party vessels, and jetty facilities within the scope of the coverage limits.

The course participant is fully liable for damage caused intentionally or through gross negligence. To the extent permitted by law, YouBoat GmbH disclaims all liability for theft or damage to participants' personal property, as well as for personal injury and property damage. Personal accident insurance is the responsibility of the participants.

10. Vouchers

Gift vouchers are valid for 5 years (60 months); cash payouts are not permitted.

Promotional vouchers can only be redeemed for new bookings and cannot be applied to existing bookings or courses that have already started. Promotional vouchers cannot be combined with other vouchers or discounts, and cash payouts are not permitted. Promotional vouchers are valid for 12 months from the date of issue.

11. Place of Jurisdiction and Applicable Law

Swiss law shall apply exclusively. The place of jurisdiction for any disputes is the registered seat of YouBoat GmbH in Rapperswil SG, subject to mandatory statutory places of jurisdiction.

12. Data Protection Notice

The collection and processing of personal data are conducted in accordance with the provisions of Swiss data protection legislation. Details are set out in the Privacy Policy on our website: [https://www.boat-school.ch/datenschutz].

13. Severability Clause

Should any provision of these Terms and Conditions be invalid, the remaining provisions of the contract shall nevertheless remain effective.
